Terms of Use
These Terms of Use ("Terms") govern your access to and use of the ProAura Health website and the Services we make available. By using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. About the Services
ProAura Health is a telehealth-focused brand and technology platform. ProAura Health is not a medical practice and does not provide medical advice, diagnosis, or treatment. Clinical services, including eligibility review, prescribing decisions, and ongoing care, are provided by independently licensed clinicians and partnered medical groups.
2. Eligibility
The Services are available to adults aged 18 or older who are physically located in the United States. Treatment is provided only when a licensed clinician determines it is medically appropriate based on your full medical history and applicable clinical guidelines. ProAura Health does not guarantee that any prescription will be issued.
3. Account and accurate information
You agree to provide accurate, current, and complete information during the intake and to keep that information up to date. You are responsible for maintaining the confidentiality of any login credentials and for activity that occurs under your account.
4. No medical advice
Content on the ProAura Health website is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified clinician with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Services.
5. Payment, billing, and cancellation
- Membership is billed on a recurring monthly basis until cancelled. You will see all charges before any payment is processed.
- Medication, if prescribed, may be billed separately based on the medication, dose, and pharmacy.
- You may cancel future renewals at any time. Cancellation does not retroactively refund completed billing cycles, except as required by applicable law.
- ProAura Health does not bill insurance. The Services are self-pay.
6. Telehealth consent
By using the Services, you consent to receive care through telehealth modalities, including secure messaging and video, where appropriate. Detailed informed-consent documents are provided by the clinical practice at the start of your care relationship.
7. Prohibited uses
- Using the Services to obtain medication for resale, distribution, or for any person other than yourself.
- Providing false, misleading, or impersonated information.
- Attempting to interfere with the security or operation of the Services.
- Using the Services in any manner that violates applicable law.
8. Intellectual property
The Services, including all content, trademarks, and software, are owned by ProAura Health or its licensors and are protected by applicable intellectual property laws. You are granted a limited, revocable, non-exclusive license to use the Services for your personal, non-commercial use.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ProAura Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. ProAura Health does not warrant that the Services will be uninterrupted, error-free, or completely secure.
10. Limitation of liability
To the maximum extent permitted by law, ProAura Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. ProAura Health's total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to ProAura Health in the twelve months preceding the claim.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved as set forth in the dispute-resolution section provided at signup, which may include binding individual arbitration.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by reasonable means. Continued use of the Services after the effective date of a change constitutes acceptance of the updated Terms.
